First, the international community should spell out the kinds of failures to protect civilians that can justify armed interventions by other states, as well as which agency has the authority to determine when such failures have occurred. In other words, the international community should determine how low to set the bar for intervention, and who makes the rules. Second, the international community needs to establish an additional international responsibility, namely, a responsibility to prevent international terrorism. The next section argues that state sovereignty has never been considered absolute.

The Responsibility to Protect

R2P was intended to be the first piece in a new international legal framework for stopping war crimes after a century of ad hoc humanitarianism. State sovereignty is an important and sensitive issue for the countries recently freed from the yoke of Western rule and one that will be used for decades to come as an argument against humanitarian intervention. All three wars are fought under the banner of national interest, but as each also aimed to avert the mass slaughter of civilians, international-law scholars later look to them as precursors — however faint — of the humanitarian interventions to come. Susan Rice, then an aide on U. The influential treatise argues that sovereign states are defined not by the inviolability of their borders — the assumption of the post-colonial era — but by their obligation to protect their citizens. China and Russia veto it, but NATO, eager to avoid a repeat of its mids failures, starts bombing anyway.

The international community in the last decade repeatedly made a mess of handling the many demands that were made for "humanitarian intervention": coercive action against a state to protect people within its borders from suffering grave harm. There were no agreed rules for handling cases such as Somalia, Bosnia, Rwanda, and Kosovo at the start of the s, and there remain none today. Disagreement continues about whether there is a right of intervention, how and when it should be exercised, and under whose authority. Since September 11, , policy attention has been captured by a different set of problems: the response to global terrorism and the case for "hot preemption" against countries believed to be irresponsibly acquiring weapons of mass destruction. These issues, however, are conceptually and practically distinct. There are indeed common questions, especially concerning the precautionary principles that should apply to any military action anywhere. But what is involved in the debates about intervention in Afghanistan, Iraq, and elsewhere is the scope and limits of countries' rights to act in self-defense -- not their right, or obligation, to intervene elsewhere to protect peoples other than their own.

Responsibility to Protect: A Short History

Sovereignty , in political theory, the ultimate overseer, or authority , in the decision-making process of the state and in the maintenance of order. The concept of sovereignty—one of the most controversial ideas in political science and international law —is closely related to the difficult concepts of state and government and of independence and democracy. However, its application in practice often has departed from this traditional meaning. In 16th-century France Jean Bodin —96 used the new concept of sovereignty to bolster the power of the French king over the rebellious feudal lords, facilitating the transition from feudalism to nationalism. The thinker who did the most to provide the term with its modern meaning was the English philosopher Thomas Hobbes — , who argued that in every true state some person or body of persons must have the ultimate and absolute authority to declare the law; to divide this authority, he held, was essentially to destroy the unity of the state. The theories of the English philosopher John Locke — and the French philosopher Jean-Jacques Rousseau —78 —that the state is based upon a formal or informal compact of its citizens, a social contract through which they entrust such powers to a government as may be necessary for common protection—led to the development of the doctrine of popular sovereignty that found expression in the American Declaration of Independence in A parliament, he argued, is a supreme organ that enacts laws binding upon everybody else but that is not itself bound by the laws and could change these laws at will.

What counts as sovereignty depends on the nature and structure of the international legal order and vice-versa. The United Nations UN system itself is based, albeit not directly on the principle of sovereignty itself, on a necessary corollary of that principle: the principle of sovereign equality of its Member States as guaranteed in Art. However, the entry pertains to international law and international law theory only, and is not concerned with the distinct albeit connected sovereignty issues that arise within international relations theory or political theory more generally except to explain some of the political dimensions of the principle of sovereignty in international law. Nor does it pertain to dimensions of the debate that are specific to the EU except when they are relevant to the evolution of sovereignty in international law. It is actually important to discuss sovereignty separately from many of those correlated principles as the latter are mostly also attributes of statehood under international law and their fate in contemporary international law is closely tied to that of States, whereas sovereignty need not necessarily be.

The Responsibility to Protect populations from genocide, war crimes, crimes against humanity and ethnic cleansing has emerged as an important global principle since the adoption of the UN World Summit Outcome Document in The Responsibility to Protect — known as R2P — is an international norm that seeks to ensure that the international community never again fails to halt the mass atrocity crimes of genocide, war crimes, ethnic cleansing and crimes against humanity. The concept emerged in response to the failure of the international community to adequately respond to mass atrocities committed in Rwanda and the former Yugoslavia during the s. It is articulated in paragraphs and of the World Summit Outcome Document :. Each individual State has the responsibility to protect its populations from genocide, war crimes, ethnic cleansing and crimes against humanity.

In invoking the “responsibility to protect,” the resolution draws on the principle that sovereign states are responsible and accountable to the international.

What is R2P?

Sovereignty, though its meanings have varied across history, also has a core meaning, supreme authority within a territory. It is a modern notion of political authority. Historical variants can be understood along three dimensions — the holder of sovereignty, the absoluteness of sovereignty, and the internal and external dimensions of sovereignty. The state is the political institution in which sovereignty is embodied.

One of the liveliest debates of post-Cold War international relations is that of humanitarian interventionism. Conceptualized by the ICISS in , and explicitly endorsed in the World Summit Outcome Document, R2P, in brief, refers to the idea that each sovereign state has a primary responsibility to protect its people from suffering grave harm, and if it is unable or unwilling to do so, this responsibility is transferred to the international society Bellamy, This international responsibility consists of preventing the humanitarian crisis, reacting to it and rebuilding after ICISS, However, a shift from the discourse does not necessarily imply a shift from the main sources of controversies in the debate.

The Responsibility to Protect R2P or RtoP is a global political commitment which was endorsed by all member states of the United Nations at the World Summit in order to address its four key concerns to prevent genocide , war crimes , ethnic cleansing and crimes against humanity.
